The Rutherford Institute has developed a 10-point checklist and policy for schools to follow before giving students a breathalyzer test.
This comes after a recent controversy where a Western Albemarle High School resource officer gave a sophomore a breathalyzer test, which the student passed.
The institute describes itself as "a non-profit conservative legal organization dedicated to the defense of civil, especially religious, liberties and human rights." Their policy calls for administrators to observe students behavior, like walking and talking. If the checklist is questionable, a parent must give consent for a blood alcohol test.
John Whitehead from the Rutherford Institute said, "What our policy will do, it will protect parents rights and make sure the schools are fulfilling the idea of getting credible evidence, reasonable suspicion before they administrator a breathalyzer test."
Whitehead sent his policy to Western Albemarle. He said if he does not get a response, he will petition the school board to adopt his policy or one similar to it.
