Attorneys in Spotsy High 'Spitball' Case ask for Rehearing

Attorneys for Spotsylvania High School student Andrew Mikel II are asking the Virginia Supreme Court for a rehearing in his case after it refused to grant his request for a reversal of his long-term suspension, the Rutherford Institute announced this morning.

Andrew was a 14-year-old freshman in December 2010 when he was suspended for the remainder of the 2010-11 school year for shooting plastic balls through a tube at classmates.

The Virginia Supreme Court refused to grant Andrew’s initial request for an appeal of his suspension, the attorneys said in their statement.

Andrew’s attorneys are asking the court to reverse his long-term suspension.

Andrew returned to school in August to begin the 2011-12 school year.
